About

The Maritime Labour Mediation and Arbitration Centre (MAC) was established at "9 Level 4 TRIQ IL-PAPA URBANU VIII BIRKIRKARA BKR 1425 Malta" to resolve disputes between Turkish and/or foreign national seafarers covered by any of the ITF (International Transport Workers' Federation) agreements and working on FOC (Flag of Convenience) ships and shipowners and operators (and other parties, if any). In Turkey, the MAC is located at "Bagdat Cad. Cemre Sok. No:12/9 34724 Kızıltoprak, Kadıköy/İstanbul" in Turkey.

Arbitration is a method of resolving disputes in a fair and reliable manner, within a reasonable time and at an affordable cost, by arbitrators freely chosen by the parties. In this way, MAC seeks to resolve disputes by taking into account the unique rules, realities and maritime traditions of the maritime sector. Arbitration helps to resolve disputes in a short time and at a low cost, rather than through lengthy court proceedings.

Arbitration allows the parties to determine the rules of procedure, the applicable law, the seat of the arbitration, the language of the arbitration and the arbitral tribunal. Arbitral awards are final and easily enforceable. These reasons make arbitration effective in meeting the needs of the maritime sector. Awards made under these Rules shall be enforceable and shall be binding on all parties.

The Council is the body of the MAC established to resolve disputes arising from the contract concluded between the parties through arbitration. The Council and its Secretariat shall evaluate the requests to be submitted to the MAC, collect information and documents and provide them to the parties as necessary, communicate with the parties, conduct, monitor and supervise the selection of arbitrators and the formation of the arbitral tribunal, manage the dispute resolution process by the arbitral tribunal, and monitor and supervise the entire process from a procedural point of view. The Council is the only body empowered to administer the arbitration, including the review of awards made under the Rules.

Information on the operation and conduct of the arbitration is set out in detail in the "Maritime Labour Mediation and Arbitration Centre, Rules of Arbitration".

Applications to the MAC can be made online via the website www.denizciliktahkim.org, e-mail address info@denizciliktahkim.org.
